By accessing the Website or placing an order, you agree to these Terms, along with our Privacy Policy, Shipping Policy, and Return & Refund Policy. If you do not agree, please do not use the Website.

1. Eligibility

You must be at least 18 years old, or use the Website under the supervision of a parent or legal guardian, and be capable of entering into a legally binding contract under the Indian Contract Act, 1872.

2. Our Business Model

SmartMart360 is an online retailer. Our products are sourced from and shipped directly by trusted third-party suppliers and fulfilment partners across India. This means:

  • Items in one order may be shipped from different warehouses and may arrive in separate packages on different days.
  • Packaging and courier partners may vary.
  • SmartMart360 remains your point of contact for all orders, support, returns, and refunds.

3. Products and Descriptions

  • We try to display products, colours, sizes, and features as accurately as possible. However, actual colours may vary slightly depending on your screen, and product images may be illustrative.
  • Product descriptions and specifications are based on information provided by suppliers and manufacturers. Minor variations in design, packaging, or accessories may occur.
  • All products are subject to availability. We may limit quantities or discontinue products at any time.
  • Health and personal care products (such as neck pillows, hair removers, or fitness items) are for general use only and are not medical devices. They are not intended to diagnose, treat, or cure any condition. Consult a doctor if you have a medical concern. Read and follow the usage instructions and safety warnings provided with each product.

4. Pricing and Payment

  • All prices are in Indian Rupees (INR) and include applicable taxes unless stated otherwise.
  • "Compare at" or "MRP" prices shown with a strike-through indicate the original or reference price.
  • Shipping charges and any COD fee, if applicable, are shown at checkout before you pay.
  • We accept payments through Shopify and our authorised payment gateways (UPI, cards, net banking, wallets) and Cash on Delivery for eligible pin codes.
  • In case of an obvious pricing or listing error, we reserve the right to cancel the order and refund any amount paid in full.

5. Orders

  • Placing an order is an offer to buy. An order is accepted only when we dispatch it.
  • We may refuse or cancel an order if we suspect fraud, the address is incomplete or not serviceable, the item is out of stock, or there was a pricing error.
  • For Cash on Delivery orders, we or our partners may call or message you to confirm the order before dispatch. Unconfirmed orders may be cancelled.
  • We may restrict COD for customers with a history of refused or undelivered orders.

6. Shipping, Returns and Refunds

Delivery is governed by our Shipping Policy, and returns, replacements, cancellations, and refunds are governed by our Return & Refund Policy. Both form part of these Terms.

7. Customer Responsibilities

You agree to:

  • Provide accurate and complete information, including your name, phone number, and delivery address
  • Be available to receive your delivery and keep your phone reachable
  • Record an unboxing video as described in our Return & Refund Policy if you want to raise a claim
  • Use products only as intended and follow the provided instructions
  • Not misuse the Website, including attempting unauthorised access, uploading harmful code, placing fake orders, or submitting false claims or reviews

8. Reviews and Content You Submit

When you post a review, photo, or comment on our Website or social media, you give us a non-exclusive, royalty-free right to display and use that content to promote our store. Your review must be honest and based on your real experience. We may remove content that is false, offensive, or unlawful.

9. Intellectual Property

The SmartMart360 name, logo, website design, text, graphics, and original content are owned by or licensed to us. You may not copy, reproduce, or use them for commercial purposes without our written permission. Product brand names and trademarks belong to their respective owners.

10. Warranty Disclaimer

Products are sold "as is," except for any warranty provided by the manufacturer or stated on the product page. To the maximum extent permitted by law, we do not give any other warranties, express or implied. Nothing in these Terms limits your rights under the Consumer Protection Act, 2019.

11. Limitation of Liability

To the maximum extent permitted by law, SmartMart360 will not be liable for any indirect, incidental, or consequential loss arising from the use of our Website or products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

12. Indemnity

You agree to indemnify SmartMart360 against any claims, losses, or damages resulting from your breach of these Terms, misuse of our products, or violation of any law.

13. Force Majeure

We are not responsible for delays or failure to perform due to events beyond our reasonable control, such as natural disasters, floods, pandemics, strikes, lockdowns, courier disruptions, or government action.
